Please read these Terms and Conditions carefully before using the Formanova website or enrolling in a programme. By using the website or enrolling, you agree to be bound by these terms. If you do not agree, please do not use the website or submit an enrolment. For legal enquiries, contact [email protected].
1. Definitions
Key Terms
- "Agreement" means these Terms and Conditions, together with any enrolment confirmation and the programme scope document.
- "Formanova", "We", "Us", "Our" means Formanova, a business education provider operating from 90 Jalan Kuchai Lama, 58200 Kuala Lumpur, Malaysia.
- "Programme" means any of the management education programmes offered by Formanova, as described on the website.
- "Participant" means any individual who has enrolled in a Formanova programme.
- "User" means any person accessing or using the Formanova website.
- "Content" means all materials, curricula, workbooks, session recordings, exercises and other resources provided as part of a programme.
- "Website" means the Formanova website at formanov.biz.
2. Acceptance of Terms
How This Agreement Is Formed
By accessing the website or submitting an enrolment enquiry or payment, you confirm that:
- You are at least 18 years of age;
- You have the legal capacity to enter into a binding agreement;
- You have read and understood these Terms and Conditions and agree to be bound by them.
If you are enrolling on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
3. Programme Description
What Formanova Offers
Formanova offers structured management education programmes for working professionals. The current programmes are:
- Product and Market Research Basics (5 weeks, online)
- Growth Operations Track (13 weeks, online)
- Senior Practice Programme (10 months, online with monthly in-person intensives in Kuala Lumpur)
Each programme has a written scope document setting out what is included and what is not. This document is provided before enrolment is confirmed. Programme availability is subject to cohort capacity and scheduling. Formanova reserves the right to modify programme content to reflect current practice, provided the overall scope and objectives remain materially consistent.
Programmes are delivered primarily in English. Participants are expected to have sufficient English proficiency to engage with written materials and participate in discussions.
4. Enrolment
Enrolment Process and Confirmation
Enrolment is confirmed only when:
- A completed enrolment enquiry or form has been submitted;
- Formanova has confirmed acceptance of the enrolment in writing; and
- The programme fee has been received in full (or an approved instalment arrangement is in place).
Formanova may decline an enrolment at its discretion, including where cohort capacity is reached. In that case, any fee received will be refunded in full.
5. User Responsibilities
Participant Conduct
Participants agree to:
- Engage with the programme honestly and in good faith;
- Complete assessments and submitted work independently and without misrepresenting authorship;
- Treat other participants, facilitators and advisers with respect;
- Not record, reproduce or distribute session content without prior written permission from Formanova;
- Not share programme materials, workbooks or guide libraries outside the cohort without written permission.
Formanova may remove a participant from a programme for conduct that materially breaches these requirements. In such cases, no refund will be provided for fees paid.
6. Intellectual Property
Ownership of Programme Materials
All programme content, including session materials, workbooks, guide libraries, exercises and assessment frameworks, is the intellectual property of Formanova. Enrolment grants participants a limited, non-exclusive, non-transferable licence to use these materials for personal learning purposes during and after the programme.
Participants retain ownership of work they produce during the programme, including research write-ups, experiment portfolios and applied projects. By submitting this work for assessment, participants grant Formanova a non-exclusive right to retain a copy for internal records and quality assurance purposes.
Participants may not reproduce, distribute, sell or create derivative works from Formanova programme materials without prior written consent.
7. Payment Terms
Fees, Payment and Refunds
Fees: Programme fees are stated in Malaysian Ringgit (RM) and are inclusive of all materials, sessions, support structures and assessments described in the programme scope document. Fees are subject to change for future cohorts; enrolled participants are not affected by fee changes after their enrolment is confirmed.
Payment methods: We accept bank transfer, online banking (FPX) and card payment. Instalment arrangements may be available for longer programmes at Formanova's discretion.
Refund policy:
- Cancellation more than 14 days before the programme start date: full refund of fees paid.
- Cancellation between 7 and 14 days before the programme start date: 50% refund of fees paid.
- Cancellation fewer than 7 days before the programme start date, or after the programme has started: no refund.
- If Formanova cancels a programme before it begins, a full refund will be issued.

8. Programme Completion
Completion Records and Assessment
Completion records are issued on successful completion of the programme, including any required assessed work. They are records of participation and documented output, not formal qualifications or academic credentials recognised under any national qualifications framework.
Assessment criteria are shared at the start of each programme. If assessed work is not submitted by the stated deadline, Formanova may issue a completion record reflecting partial completion, or may decline to issue one, depending on the extent of the shortfall.
Participants who are unable to complete a programme due to circumstances outside their control may contact Formanova to discuss options, including deferral to a later cohort. Deferrals are at Formanova's discretion and are not transferable to other programmes.
9. Disclaimers
What We Do Not Promise
Formanova's programmes are general management education and are not professional advice — legal, financial, medical or otherwise. Nothing in any programme constitutes advice specific to a participant's personal or business situation.
We do not represent that completing a programme will result in any particular outcome, including employment, promotion, business performance or financial result. The examples and case material used in programmes are for educational purposes only.
The website and programmes are provided on an "as is" basis. We make reasonable efforts to keep content current but do not warrant that all information is complete, accurate or up to date at any given time.
10. Limitation of Liability
Our Liability to You
To the extent permitted by Malaysian law, Formanova's total liability to any participant for any claim arising out of or in connection with a programme shall not exceed the total fees paid by that participant for the relevant programme.
We are not liable for indirect, consequential, incidental or special damages, including loss of profits, loss of business, or loss of data, arising from participation in a programme or use of the website, even if we have been advised of the possibility of such damages.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Force majeure: We are not liable for failure to perform any obligation to the extent that performance is prevented by circumstances beyond our reasonable control, including but not limited to natural disaster, pandemic, government order or failure of third-party infrastructure.
11. Indemnification
Your Responsibility for Claims Against Us
You agree to indemnify and hold harmless Formanova and its team members from and against any claims, damages, losses, costs or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of programme materials, or your conduct during a programme.
12. Termination
When Participation May End
Formanova may terminate a participant's access to a programme with immediate effect if the participant materially breaches these terms, including the conduct requirements in Section 5.
A participant may withdraw from a programme at any time, subject to the refund policy in Section 7. Withdrawal does not affect accrued obligations.
On termination or withdrawal, the participant's licence to use programme materials continues for personal use only, subject to the restrictions in Section 6. Sections 6, 9, 10, 11 and 13 survive termination.
13. Dispute Resolution
Governing Law and Disputes
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed venue.
Before commencing any formal proceedings, both parties agree to attempt to resolve disputes informally by written communication. Either party may initiate this by writing to the other with a description of the dispute and the outcome sought. The parties will endeavour to resolve the matter within 30 days of such notice.
14. General Provisions
Miscellaneous Legal Terms
Entire agreement: These terms, together with the programme scope document and any enrolment confirmation, constitute the entire agreement between the parties regarding participation in a programme.
Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
Waiver: Failure by Formanova to enforce any provision of these terms does not constitute a waiver of the right to enforce it in future.
Assignment: Formanova may assign its rights and obligations under these terms to a successor entity. Participants may not assign their enrolment or rights under these terms without Formanova's written consent.

15. Changes to These Terms
Updates to This Agreement
We may update these Terms and Conditions from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For enrolled participants, material changes will be communicated by email at least 14 days before they take effect. Continued participation in a programme after the effective date of changes constitutes acceptance of the revised terms.
